Terms of Service

1. Agreement to Terms

By accessing or using PeptideWise ("Website," at getpeptidewise.com) or PeptideTracker ("App," on iOS and Android), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services. These Terms constitute a legally binding agreement between you and Jonathan Amparo ("we," "us," "our").

2. Description of Services

PeptideWise is an educational website providing informational content about peptides, GLP-1 medications, and related compounds, including peptide profiles, articles, research summaries, guides, and interactive calculators.

PeptideTracker is a mobile application for personal tracking and organization of injectable protocols, including dose logging, vial inventory management, injection site tracking, bloodwork logging, side effect recording, and progress photos.

Neither the Website nor the App constitutes medical advice, a medical device, or a healthcare service. See our Medical Disclaimer for full details.

3. Eligibility

You must be at least 18 years old to use the Website or App. By using our services, you represent that you are 18 or older, are legally capable of entering into binding agreements, and are not prohibited from using our services under any applicable law.

4. Subscriptions and Payment

PeptideTracker offers monthly ($9.99/month), annual ($59.99/year), and lifetime ($149.99 one-time) subscription plans. Prices may change; current pricing is always displayed in the App before purchase.

Subscriptions are billed through Apple's App Store or Google Play. Monthly and annual subscriptions automatically renew unless you cancel at least 24 hours before the renewal date.

To cancel:Go to your device's subscription settings (iOS: Settings → Apple ID → Subscriptions; Android: Google Play Store → Subscriptions). Cancellation takes effect at the end of the current billing period.

After subscription expires: You retain full read access and export capability for all your data. We never lock you out of your own health data. Premium features may be restricted to active subscribers.

5. Your Data

You own your health data. Data you enter into PeptideTracker remains your property. You grant us a limited, non-exclusive license solely to store, process, and display your data back to you within the App. We claim no ownership over your data and will never use it for any purpose other than providing the service to you.

6. Intellectual Property

All original content, design, code, and trademarks of the Website and App are owned by or licensed to us. You may share links to our pages freely but may not reproduce or redistribute substantial portions of our content without written permission.

7. User Conduct

You agree not to:

• Use the services for any illegal purpose
• Attempt to reverse engineer or extract source code from the App
• Use automated systems (bots, scrapers) to access the Website or App
• Redistribute, resell, or sublicense any part of the services
• Upload malicious code or attempt to compromise security

8. Medical Disclaimer

The full Medical Disclaimer is incorporated into these Terms by reference. By using our services, you acknowledge that our services are not medical devices and do not provide medical advice, that you will consult a qualified healthcare provider for all medical decisions, and that we do not recommend, endorse, or facilitate the acquisition of any compound.

9. No Warranties

The Website and App are provided "as is" without warranties of any kind. We do not warrant that information is complete, accurate, or current, that the App will be uninterrupted or error-free, or that results will be accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE PRIOR 12 MONTHS OR $100.

11. Indemnification

You agree to indemnify and hold harmless PeptideWise, PeptideTracker, and their operator from claims arising from your use of the services, your violation of these Terms, or any health decisions you make based on information obtained from our services.

12. Dispute Resolution

Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Small claims exception: Either party may bring an individual action in small claims court.

Opt-out: You may opt out of arbitration by emailing [email protected] within 30 days of first using the services.

These Terms are governed by the laws of the State of California.

13. Termination

You may stop using the services at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, you may export your data. Sections on liability, indemnification, dispute resolution, and intellectual property survive termination.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated through an updated effective date and, where feasible, a notice within the App. Continued use constitutes acceptance of revised Terms.

15. Entire Agreement

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and us regarding the services.
